Obtaining an EB-5 Immigrant Investment Visa
Each year, 10,000 EB-5 Visas are available to foreign entrepreneurs who invest, or who are actively in the process of investing, $500,000 in a commercial enterprise in a targeted employment area that will benefit the U.S. economy and create at least 5 full-time U.S. jobs; or those who invest $1,000,000 in a commercial enterprise that will benefit the U.S. economy and create at least 10 full-time U.S. jobs.
The benefit of an EB -5 investment visa is it grants the beneficiary with the permanent resident status that allows him or her the unlimited right to live, work and do business anywhere in the U.S. The permanent resident status is also granted to the beneficiary's spouse and minor children.
New Commercial Enterprise or Existing Enterprise
If a new enterprise is created, it must benefit the U.S. economy and create employment opportunity for at least 10 full-time employees.
If the immigrant investor purchases an existing business, such enterprise will qualify if the investor will substantially restructure the business or expand the business by 140% of the net worth or jobs. The investment is also qualified if the investment was to save the jobs in a business that had lost 20% of its net worth over the past 12 or 24 months.
Once approved, the Immigrant Investor is granted conditional lawful resident status. Within 90 days from the second anniversary of the investor being admitted to the U.S. as a conditional resident, (s)he may file for removal of such condition to become a permanent resident.
Notes
The nature of the investment can be money or inventory. Simply keeping the money in the bank does not qualify.
The investment can be funded by a loan. However, the loan should be paid off in two years (before the condition residency is to be removed).
Jobs created must be 35 hour a week jobs. However, all employees don’t need to be hired right away, but they must be hired before the conditional residency is to be removed.
